The United States Supreme Court is reviewing a Florida workers compensation claim because of a potential unconstitutional ruling.
According to Business Insurance, lawyers petitioned the U.S. Supreme Court and asked for a writ of certiorari in the case Daniel Stahl v. Hialeah Hospital. The review is to determine whether or not Florida’s workers comp program is an adequate and exclusive remedy for injured Florida workers. This comes after new changes have been made to the program that eliminates permanent partial disability benefits.
“In a case where no benefits can be awarded to an injured worker to cover,” the petition read, “partial loss of future wage earning capacity.
The U.S. Supreme Court accepted jurisdiction at first, but then in April the court decided unanimously to not review the case. The U.S. Supreme Court stated that they chose not to review the court after “further consideration and hearing oral argument.”
The plaintiff in the workers comp case, Mr. Stahl, hurt his back while working as a nurse in 2003, which was two months after workers comp reforms happened. Stahl filed a lawsuit alleging that the hospital was negligent and caused his injury. He also argued that the workers comp program was insufficient and unfair.
This ruling will hopefully lead to less confusion within the Supreme Court and workers compensation claims. As of right now, the U.S. Supreme Court has not responded to any of the petition’s questioning.
